RAFAEL H. E. KHAN

Rafael H. E. Khan joined the firm in November 1995 and became a Junior Partner in July 1999. He specializes in labor relations, commercial and civil litigation, corporate rehabilitation, intellectual property, and technology law.

He provides legal advice to Philippine and multinational clients and is responsible for research, writing, and preparation of legal opinions, contracts, due diligence reports, commercial documents, and pleadings filed with various judicial and quasi-judicial tribunals, where he also appears as counsel for trial and oral argument.

He has negotiated, on behalf of clients, with third parties including Philippine and foreign lawyers and other professionals, labor unions, hostile opposing parties, and government agencies and officials. He has participated in landmark cases decided by the Supreme Court, such as Philippine Stock Exchange, Inc. vs. Puerto Azul Land, Inc. and the Securities and Exchange Commission, San Miguel Corporation vs. Secretary of Labor, and Meralco vs. Secretary of Labor.

Mr. Khan has taken a lead role in advising the firm’s clients engaged in business process and outsourcing and information technology, rendering legal advice on problems unique to their industry as well as on the Philippine e-commerce law and equivalent U.S. statutes.

He was a consultant for the Department of Labor and Employment, Labor Law for Managers Lecture Series in 1999, 2001, and 2006. He also worked as a consultant for the Office of Senator Blas F. Ople from 1995 to 1998.

He is presently a Senior Lecturer at the College of Mass Communication of the University of the Philippines-Diliman, where he teaches Law on Mass Media. He was also a lecturer in Labor Law Review and Labor Relations courses at the Perpetual Help University-Las Piñas from 1995 to 1997.

Mr. Khan earned his Bachelor of Laws from the University of the Philippines-Diliman in 1995, with a Gonzalo W. Gonzalez Award for Most Outstanding Legal Intern, and his Bachelor of Arts in Communication, Major in Journalism, also from the same university in 1991, where he graduated cum laude and with a Leadership Award.

He was the Managing Editor of the Philippine Law Journal from 1994 to 1995 and a staff member of the Philippine Collegian in 1989. He was also the Co-Captain in 1994 and Captain in 1993 of the UP College of Law Debating Team at the ASEAN Varsities Debate IV in Kuala Lumpur, Malaysia and at the Association of Law Students of the Philippines Inter-University Debate, respectively. In 1993, he was the Founding Convenor of the Students’ Alternatives for Principled Involvement. Moreover, he was the Vice-Chairman in 1989 and the Chairman in 1990 of the UP College of Mass Communication Student Council.

He is a member of Phi Kappa Phi and Pi Gamma Mu Honor Societies.
